GENERAL TERMS AND CONDITIONS FOR USING THE TICKETPRO TICKET SHOP

1. The following terms and conditions (hereinafter Conditions) apply to the visiting and using the Ticketpro ticket shop Internet site (hereinafter Ticket Shop).

2. The Ticket Shop is managed by SIA Ticketpro Baltics (hereinafter Ticketpro), reg. code.: 50103225561, legal address Kronvalda bulvaris 10-32, Riga, LV-1010, postal address: Hospitalu iela 8, Birojs 7, Riga, LV-1013, e-mail: info@ticketpro.lv

3. Ticketpro is not an organiser of any event. Ticketpro sells tickets upon the assignment, in the name and at the expense of the organiser, promoter or artist, etc. of the event. Ticketpro has no rights to establish or modify ticket prices and conditions of sale thereof, inter alia, does not decide on the arrangement of places (seats) at any events, does not buy back, replace any tickets, does not compensate for any perished, lost, stolen, damaged, etc. tickets. Ticketpro is not liable for any damages associated with the event, incl. does not compensate for the value of items lost during any event. The rights and obligations stemming from tickets are established and notified of by the organiser of the particular event, and under no circumstances does Ticketpro bear any responsibility for the contents, modification, performance, etc. of such rights and obligations.

4. Ticketpro is not a representative of the organisers, artists, etc. of any events, or of any person responsible for the organisation, contents, information, promotion or quality thereof. A person responsible for the same is the organiser of the particular event, whose data is provided on the Ticketpro Internet website, and whose contact info is stated on the ticket. Any possible claims connected with the holding of any event shall be submitted directly to the organiser.

5. Ticketpro shall have the right to limit from time to time the number of tickets purchased by one person, and interrupt any ticket purchasing transaction exceeding the permitted limit. The permitted transaction is limited by the maximum quantity of tickets that the customer can put into the Internet shop shopping basket.

6. The customer shall receive the ticket(s) in the Ticket Shop (Internet environment) upon paying for the ticket(s) according to the selected delivery method: if payment is made via a bank link, after the order confirmation is accepted, and if payment is made using a credit card – after the expiry of at least 5 business days following the date of performing the transaction at the Internet shop.

7. Tickets are delivered via courier only if the ticket has been purchased at the Ticket Shop at least 10 business days prior to the event’s start date.  Ticketpro shall not be liable for timely delivery of tickets purchased at a later date.

8. Courier service is normally available on business days between 09:00 and 18:00. If the courier is unable to deliver the ticket to the customer at the agreed address within 10 business days, the courier service shall be deemed rendered (the delivery fee shall not be refunded) and the customer can collect the ticket at the Ticketpro sales point(s) of the customer’s place of residence or seat. The customer agrees that it is the obligation of the customer to co-ordinate the place and time of receiving the ticket by the courier service provider within 10 business days following the purchase. The courier service provider and the person purchasing the ticket(s) shall agree on the time of delivery and acceptance of the ticket(s).

9. The stated delivery deadlines are approximate, and Ticketpro shall not be responsible for any delays with receiving any tickets if the same have been caused by inaccurate information, instructions provided by the Ticket Shop user, actions of third persons, and other circumstances independent of Ticketpro. Ticketpro shall have the right to suspend the delivery of any tickets using the delivery method selected by the customer, if the delivery method of the customer’s choice and the amount paid for the same do not match (incorrect address, incorrect address abroad, customer is not available). If the ticket has not been received by the above deadline, the customer is obliged to contact Ticketpro within 10 days by sending a relevant notice to the postal address Hospitalu iela 8, Birojs 7, Riga, LV-1013 or e-mail: info@ticketpro.lv.

10. Tickets shall be kept in a safe place. Direct sunlight and heat can damage the ticket.

11. Ticketpro shall not be obliged to buy back or compensate for tickets, in the case that the relevant event is cancelled, postponed or if the venue of the event is changed. The organiser of the event shall handle any buy-backs of and/or compensations for tickets, unless notified otherwise.

12. Ticketpro shall not be liable for the contents, comments, etc. data added to the Ticket Shop site by the users of the ticket sale system (users of the www.ticketpro.lv forum).

13. The Ticketpro Ticket Shop website can contain references and links to Internet based information worldwide. Inasmuch as Ticketpro does not have any control over these sites and any information contained therein, Ticketpro shall bear no liable for their accuracy, up-to-date status, contents, and information provided by the said sites.

14. Any use of the Ticket Shop website, its contents and data for any unlawful activities, as well as for the purpose of sale or resale of tickets, for advertising or business purposes or otherwise for receiving any benefits, incl. intermediation of tickets, is prohibited without Ticketpro’s prior written consent. Ticketpro shall have the right to charge a contractual penalty for breach of contract in the amount of up to 5000 LVL from any customer who has violated this provision.

15. Any user of the Ticket Shop shall refrain from interfering in any way and using any means in the functioning and technical solutions of the Ticketpro’s Ticket Shop. Any monitoring of the use of the Ticket Shop (observation, counting) and copying, reproducing, modifying, use, and publication for any purposes of any data received (incl. the contents of the website) is prohibited. Any activities which can cause overload of the Ticket Shop system and website, or any disruption of the functioning thereof is prohibited. Ticketpro shall have the right to charge a contractual penalty for breach of contract in the amount of up to 5000 LVL from any customer who has violated this provision.

16. In the event of breach of any Conditions of use of the Ticket Shop Ticketpro shall have the right to unilaterally terminate the use of the Ticket Shop and/or suspend any ticket purchasing transaction carried out by that person.

17. By performing any action on the Ticket Shop site, the Ticket Shop user confirms that:

1) he/she is an individual of at least 18 years of age, has full passive and active legal capacity for using the Ticket Shop (an individual of 7–18 years of age with limited legal capacity states accordingly that he/she has the consent of the lawful representative for using the Ticket Shop services, and has received from the latter the resources necessary to purchase the ticket);

2) it is a legal entity whose representative has all and any powers to use the Ticket Shop services in the name of that person, and to assume any obligations for that legal entity;

3) the person duly complies with all the terms of use of the Ticket Shop;

4) the person is aware that should the username and password provided for the use or visiting the Ticket Shop be disclosed to any third person the customer shall be liable for the performance of the obligations assumed by such persons for the customer.

18. With the exception of the username and password Ticketpro does not perform any verification of the identity of the Ticket Shop user. The customer confirms that any data provided by the customer to Ticketpro have been provided voluntarily and with the consent of the customer. The customer agrees to grant Ticketpro permission for processing the customer’s personal data (first name and surname, place of residence, e-mail, username, password, etc.). Ticketpro shall guarantee customer data confidentiality.

19. When tickets are purchased at a special price Ticketpro does not verify whether or not the purchaser meets the conditions of eligibility for such special price. Purchasing of a special-priced ticket does not guarantee access to the event. The fact of whether or not the person providing a special-priced ticket is eligible for the access to the event on special terms is verified at the venue of the event by persons authorised by the organiser.

20. Neither Ticketpro nor the organiser are obliged to verify whether the person presenting the ticket is the person who has purchased it, and are not liable for any damages stemming from the same. When a customer enters a concert on the basis of a ticket printed out by the customer, the customer shall be deemed entered the venue when the customer first submits the printout of the ticket for scanning by the organiser. Tickets with identical bar code have no legal binding with respect to Ticketpro or the organiser.

21. Ticketpro shall have the right to amend the Conditions of use of the Ticket Shop by publishing the relevant information/news in the news section of the www.ticketpro.lv site. The amendments enter into effect upon their publication on the Ticket Shop website.

22. Any claims pertaining to the holding, contents, quality, advertising, etc. shall be submitted to the organiser of the event.

23. Any disputes arising out of the use of the Ticket Shop site shall be resolved by negotiations; if agreement is not reached the dispute shall be resolved in accordance with the legislation of the Republic of Latvia.

24. Ticketpro does not see card data related to any transactions carried out by the customers. For the purpose of consummating the transaction the customers are redirected to the safe environment of the Card Centre of Banks. At the time of payment the card holder inputs the card data into the database located in the Card Centre server, and any data pertaining to the transaction are also stored in the server of the Card Centre. Ticketpro shall bear no liability for the accuracy or incorrectness of card data. For the purpose of fraud prevention Ticketpro may monitor IP addresses of its customers to detect orders from the same IP address using different cards or placed in the name of different recipients. In the case of any fraud is suspected Ticketpro shall notify the Bank thereof.

25. In the case of suspected card payment frauds the Bank shall have the right to suspend the processing of the transaction for the period of investigation, or cancel the transaction. In such case the bank shall notify Ticketpro of such investigation pertaining to the transaction and Ticketpro shall not be allowed to release the goods before such investigation is completed.

26. When card data are requested the SSL, MasterCard Secure Code and Verified by Visa systems are used.

27. The customer shall keep the password and username provided for the purpose of using the site in a manner that will prevent them from being disclosed to any third persons, unless the customer has authorised such third persons to represent the customer in respect of using the service.

28. The customer shall be obliged to notify Ticketpro forthwith by e-mail of any data and circumstances, which have changed after they were provided when the customer first completed his/her registration as the site user.

29. The Conditions shall enter into force upon their acceptance by the customer, and shall remain effective for the duration of any legal relationship between the customer and Ticketpro governed by these Conditions. The customer shall have the right to withdraw from these Conditions within 14 days following their acceptance; furthermore, the customer has the right to cancel the legal relationship governed by these Conditions at any time, subject to having previously performed any outstanding obligations before Ticketpro.

30. The customer agrees to receive information letters sent by Ticketpro to the e-mail address provided by the customer.

31. When the customer withdraws from the contract Ticketpro shall be obliged to refund the value of the ticket, less any service and commission fees. In the event of the customer’s withdrawal from the contract Ticketpro shall have the right to charge a commission fee the amount of which is stated on the ticket.

32. In the case that a bank card is used for payment the only way to cancel the transaction is sending an application to the bank stating the data of the transaction. The application shall also state the reason for cancellation. Other channels cannot be used to refund moneys. The card holder shall be notified of the cancellation of the transaction in writing only provided that the goods have been returned and the transaction is cancelled on the basis of a written application of the customer.
